1.  Border control on trademark infringement

(1) Is there a system in which the Customs or the like suspends importation of trademark infringing goods on its own initiative or based on a claim filed by the IPR holder?

=> There is no the written procedure or system in the customs suspends importation of trademark infringing goods at the moment.

However, according to the Law on Custom No. 05/NSA, at Vientiane Capital, dated 20 May 2005, Article 15. Goods, items that be prohibited.

1.  INTRODUCTION TO IPR ENFORCEMENT IN LAO PDR

The only intellectual property law in force in the Lao PDR at the moment is a Prime Minister's Decree on Trademarks No 06/PM (1995) and a Prime Minister's Decree on Patent, Petty Patent and Industrial Designs No 01/PM (2002). Lao PDR legislation gives the holder of an intellectual property right the possibility of recourse to either the civil court or the penal court for an order to cease the infringements of his rights. Abuse of these procedures is subject to penalties under the Civil Procedure Law, the Penal Law and the Penal Procedure Law of Lao PDR.

The cancellation of non-use of a trademark in Laos does not automatically apply to the owner as Lao system has not yet the database system to control upon this regard. Therefore, the owner of the registered trademark should not take any action unless it has been challenged by a third party in relation the trademark.
